In Land Fraud Cases, The Court Denies Anticipatory Bail To Ardee City Builder

A city court on Monday denied the director of Ardee City’s builder’s anticipatory bail application, accusing him of forging documents to obtain a licence for approximately 40 acres of land owned by the HSVP and failing to develop the area earmarked for EWS plots in Sector 57, Gurugram.

Additional Sessions Judge Jasbir Singh denied Gopal Das Estates & Housing director Shibani Verma Kapur’s application, stating that the charges were serious and that treating such offences lightly would be injustice.

“Taking such offences lightly, ignoring such tactics, and enlarging them on anticipatory bail is nothing but injustice to the honest, hardworking, and weaker sections of society, “the judge said. The court also stated that property fraud by builders was on the rise.

“Such types of property fraud committed by powerful builders have become the norm and have a greater impact on society.” The judge stated, “The mode of operation in this case suggests meticulous planning and deft execution to defraud EWS.”

In September 2021, Gurugram police filed two FIRs against the company and its senior executives for allegedly forging documents in order to obtain the land licence from the DTCP.

Land Fraud Cases

When the developer applied for a revision of Ardee City’s layout in 2015, DTCP became aware of the alleged fraud. DTCP discovered that the land on which EWS plots were to be developed in Sector 57 was not even owned by the builder after writing to the Haryana Shahari Vikas Pradhikaran (HSVP) and the revenue department. DTCP revoked the licence and filed a second complaint against Gopal Das Estates and Housing in 2021.

Shibani Verma Kapur, through her lawyer Vishal Gupta, claimed that the FIR was filed because of vested interests. “I was not in charge of obtaining any licences for Ardee City.” In 2002, I was neither an employee nor a director, and I held no position in the company “Custodial interrogation is unnecessary because the entire case is based on documentary evidence,” Kapur contended.
